These Terms & Conditions (“Terms”) govern all sales, orders, and services provided by Blackhawk MillWorks. By placing an order, submitting payment, accepting an invoice, or conducting business with Blackhawk MillWorks in any form, the customer (“Client”) agrees to be bound by these Terms without exception.


1. Orders & Acceptance

Orders are considered accepted only when:

  • An invoice has been issued, and

  • Full payment has been submitted and successfully processed.

Blackhawk MillWorks reserves the right to accept or decline any order at its sole discretion.

All quotes, estimates, and verbal communications are non-binding until formal invoicing.


2. Payment Requirements

All orders require 100% upfront payment before materials are prepared, allocated, cut, processed, or shipped.

Accepted payment methods include:

  • Square Invoice

  • Bank transfer / wire transfer

  • Business or personal check (must clear before release)

No work will begin until payment is confirmed.


3. All Sales Are Final

All purchases are made on a strictly final-sale basis.
Blackhawk MillWorks does not offer:

  • Refunds

  • Returns

  • Exchanges

  • Cancellations

  • Store credit

This applies to all slabs, lumber, custom furniture, hardware, and services.


4. Material Characteristics

Wood is a natural product. The Client acknowledges that:

  • Variations in color, grain, texture, figure, knots, and movement are normal.

  • Checks, cracks, voids, and natural imperfections may exist.

  • Moisture content may change after delivery due to environmental conditions.

  • No two slabs or boards are identical.

Blackhawk MillWorks is not responsible for natural properties or changes that occur after delivery or installation.


5. Custom Work & Modifications

Custom milling, surfacing, flattening, epoxy work, or furniture production is performed according to the specifications provided by the Client.

Once custom work has begun, no changes, cancellations, or modifications are permitted.


6. Shipping & Delivery

Blackhawk MillWorks ships nationwide. Shipping terms include:

  • The Client is responsible for providing accurate delivery information.

  • Shipping dates are estimates and not guaranteed.

  • Damage during transit is the responsibility of the carrier unless optional insurance has been purchased by the Client.

  • Freight shipments may require Client presence for receiving.

Blackhawk MillWorks is not liable for delays caused by carriers, weather, or force majeure events.


7. Risk of Loss

Ownership transfers to the Client when the order is handed over to the shipping carrier or picked up locally.
At that moment, all risk of loss or damage becomes the Client’s responsibility unless insurance has been purchased.


8. Inspection Upon Delivery

The Client must inspect all delivered materials immediately.
Any concerns regarding shipping damage must be noted with the carrier at the time of delivery.

Blackhawk MillWorks is not responsible for issues reported after the shipment has been accepted without notation.


9. Limitation of Liability

Blackhawk MillWorks is not liable for:

  • Incidental or consequential damages

  • Client installation errors

  • Improper storage or handling

  • Structural failures caused by natural wood movement

  • Costs related to project delays or contractor schedules

Maximum liability, if ever applicable, is limited strictly to the amount paid for the product or service.


10. Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of Texas.
Any disputes shall be resolved exclusively in the courts of Hays County, Texas.


11. Acceptance of Terms

By placing an order or submitting payment, the Client acknowledges that they have read, understood, and agreed to all Terms & Conditions listed above.
